1. Agreement to Terms
By accessing or using Twentyfirst AI ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and FollowerX GmbH ("Company", "we", "us", or "our"). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
Twentyfirst AI is a unified platform that provides access to thousands of AI models through a subscription-based service. We aggregate and translate AI models from third-party providers, primarily Replicate.com, making them available in multiple languages with optimized interfaces. Our platform serves as an intermediary between users and various AI model providers, offering a simplified and accessible way to interact with cutting-edge artificial intelligence technologies without requiring technical expertise.
The Service encompasses a comprehensive ecosystem designed to democratize access to AI capabilities. Users can access a diverse catalog of AI models covering various purposes including text generation, image creation, video generation, audio synthesis, and numerous other specialized applications. Each model is carefully integrated into our platform with user-friendly interfaces that abstract away the technical complexities typically associated with AI model deployment.
Our platform includes robust user authentication and account management systems that ensure secure access to the Service. We offer flexible subscription plans with a credit-based usage system that allows users to consume AI model services according to their needs. The credit system provides transparency and control over usage, enabling users to manage their AI consumption efficiently.
To enhance accessibility, we provide comprehensive multi-language support with automatic translation capabilities. This ensures that users from different linguistic backgrounds can effectively utilize our platform and understand the capabilities of various AI models. Additionally, we offer free tools including JSON translation utilities, photo restoration services, and email scam detection capabilities, which serve as value-added features that complement our core subscription offerings.
For business customers, we provide specialized company profile management features that enable organizations to manage team access, track usage across departments, and maintain professional account settings. Business accounts may include additional features such as VAT number management, company-wide billing, and enhanced support options tailored to enterprise needs.
3. User Accounts and Registration
3.1 Account Creation
To access and utilize the full range of features offered by our Service, you must register for an account. Account registration is a straightforward process that requires you to provide certain information necessary for account management, service delivery, and compliance with legal obligations. During the registration process, you will be asked to provide information such as your email address, which serves as your primary account identifier, and a secure password that protects your account from unauthorized access.
By creating an account, you enter into a binding agreement to maintain the accuracy and completeness of all information associated with your account. This obligation extends throughout your use of the Service, meaning you must promptly update your account information whenever changes occur. Maintaining current and accurate information is essential not only for account security but also for ensuring proper service delivery, billing accuracy, and compliance with applicable regulations.
Account security is a shared responsibility between you and us. While we implement robust security measures to protect your account, you bear the primary responsibility for maintaining the confidentiality of your password and other account credentials. You must not share your account credentials with any third party, and you must take reasonable precautions to prevent unauthorized access to your account. This includes using strong, unique passwords, enabling two-factor authentication when available, and logging out of your account when using shared or public devices.
You are fully responsible for all activities that occur under your account, regardless of whether such activities are authorized by you. This means that if someone gains access to your account and uses it in violation of these Terms, you may be held liable for those violations. If you become aware of any unauthorized use of your account or any breach of security, you must notify us immediately. Prompt notification allows us to take appropriate security measures to protect your account and prevent further unauthorized access.
3.2 Eligibility
The Service is intended for use by individuals who are at least 18 years of age and have the legal capacity to enter into binding contracts. By accessing or using the Service, you represent and warrant that you meet these eligibility requirements. If you are under the age of 18, you may not use the Service, and if you are a parent or guardian who becomes aware that your child under 18 has provided us with personal information, you should contact us immediately so we can take appropriate action.
In addition to age requirements, you must have the legal capacity to enter into these Terms under the laws of your jurisdiction. This means you must not be subject to any legal disability that would prevent you from entering into binding agreements, such as being under guardianship or having been declared legally incompetent. You must also not be prohibited from using the Service under any applicable laws, regulations, or court orders.
All information you provide during registration must be truthful, accurate, and complete. Providing false, misleading, or incomplete information may result in immediate termination of your account and may expose you to legal liability. We reserve the right to verify the accuracy of information you provide and to request additional documentation or verification when necessary, particularly for business accounts or accounts that exhibit suspicious activity.
3.3 Account Types
We offer two primary types of accounts: individual accounts and business accounts. Individual accounts are designed for personal use and provide access to all standard features of the Service. Business accounts are tailored for organizations and may include additional features such as team management, centralized billing, usage analytics, and administrative controls.
Business accounts may require additional verification and information beyond what is required for individual accounts. This may include company registration details, VAT numbers for tax compliance, official business addresses, and verification of the authorized representative creating the account. The additional information required for business accounts helps us ensure proper billing, tax compliance, and account security for organizational customers.
4. Subscription Plans and Payment
4.1 Subscription Plans
We offer various subscription plans with different credit allocations and features. Plan details, pricing, and features are subject to change at our discretion. We will provide reasonable notice of any material changes to subscription plans.
4.2 Payment Terms
All payments for subscription services are processed through Stripe, a reputable third-party payment processor that complies with industry-standard security requirements including PCI DSS (Payment Card Industry Data Security Standard). By subscribing to our Service, you authorize us to charge your designated payment method for all fees associated with your selected subscription plan. This authorization remains in effect until you cancel your subscription or change your payment method.
You are responsible for providing accurate and current payment information. This includes ensuring that your payment method has sufficient funds or credit available to cover subscription fees, and that all billing information such as billing address matches the information on file with your payment provider. Failure to provide accurate payment information or maintain a valid payment method may result in service interruption or account suspension.
Subscription fees are billed in advance on either a monthly or yearly basis, depending on the billing cycle you select when subscribing. This means that when you subscribe, you pay for the upcoming billing period, and your subscription will automatically renew at the end of each billing period unless you cancel. The automatic renewal ensures uninterrupted access to the Service, but you retain the right to cancel at any time, with cancellation taking effect at the end of your current paid period.
4.3 Credit System
Our Service operates on a credit-based system that provides a transparent and flexible way to consume AI model services. Credits serve as the currency for accessing AI models through our platform. Each time you use an AI model, a certain number of credits are deducted from your account balance based on the complexity, duration, and resource requirements of the specific model and request.
Credits are allocated to your account based on your subscription plan. Different plans offer different credit allocations, with higher-tier plans typically providing more credits per billing cycle. Credits may be allocated on a monthly or yearly basis depending on your subscription plan and billing cycle. At the beginning of each billing cycle, your credit balance is automatically refilled to the amount specified in your plan, ensuring you always have credits available for use.
It is important to understand that different AI models consume credits at different rates. More complex models that require significant computational resources, longer processing times, or generate larger outputs may consume more credits than simpler models. The credit cost for each model is determined based on the actual computational resources required to execute the model, and these costs may vary as we optimize our infrastructure or as model providers adjust their pricing.
Credits may be subject to expiration policies as specified in your subscription plan. Generally, credits allocated in a billing cycle expire at the end of that cycle if unused, though some plans may offer credit rollover features. Unused credits do not carry monetary value and cannot be refunded or transferred to other accounts. It is your responsibility to monitor your credit balance and usage to ensure you maximize the value of your subscription.
4.4 Free Plan
We may offer a free plan with limited credits and features. Free plans are subject to change or discontinuation at any time without notice.
4.5 Price Changes
We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will provide at least 30 days' notice of any price increases.
4.6 Right of Withdrawal (EU Consumers)
If you are a consumer resident in the European Union, you have a 14-day right of withdrawal from the date of subscription purchase, in accordance with Directive 2011/83/EU. However, if you explicitly consent to immediate performance of the service and acknowledge that you will lose your right of withdrawal once the service has been fully performed, your right of withdrawal ends when the service is fully performed.
To exercise your right of withdrawal, you must inform us of your decision to withdraw by contacting us at business(at)twentyfirst.ai (replace "(at)" with "@") or through our support page. If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days after we are informed of your withdrawal decision.
4.7 Refunds
Subscription fees are generally non-refundable after the withdrawal period has expired. However, we may provide refunds or credits at our sole discretion in exceptional circumstances. Unused credits do not carry monetary value and are not refundable.
5. Acceptable Use
5.1 Permitted Use
You may use the Service only for lawful purposes and in strict accordance with these Terms and all applicable laws and regulations. This means that your use of the Service must comply with local, state, national, and international laws that apply to you, including but not limited to laws regarding data protection, intellectual property, consumer protection, and content regulation.
Your use of the Service must respect the rights of others, including their intellectual property rights, privacy rights, and other legal rights. This means you must not use the Service to generate, create, or distribute content that infringes on copyrights, trademarks, patents, trade secrets, or other intellectual property rights belonging to third parties. You must also respect privacy rights and not use the Service to generate content that violates the privacy of individuals, such as creating deepfakes or unauthorized likenesses of real people.
Additionally, your use of the Service must not violate any contractual obligations you may have with third parties. For example, if you are bound by a non-disclosure agreement, employment contract, or other contractual arrangement that restricts your use of AI-generated content, you must ensure that your use of our Service complies with those obligations.
5.2 Prohibited Activities
You are strictly prohibited from using the Service for any illegal purpose or in any manner that violates applicable laws, regulations, or these Terms. This prohibition extends to all aspects of the Service, including but not limited to the generation, creation, distribution, or use of content created through the Service.
You must not generate, create, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. This includes content that violates laws regarding hate speech, discrimination, harassment, or content that could cause harm to individuals or groups. Content that promotes violence, terrorism, or illegal activities is strictly prohibited and may result in immediate account termination and reporting to law enforcement authorities.
The generation of deepfakes or other misleading content intended to deceive, defraud, or harm others is strictly prohibited. This includes creating realistic but false images, videos, or audio of individuals without their consent, or creating content that could be used to impersonate others or spread misinformation. Such activities not only violate these Terms but may also constitute criminal offenses in many jurisdictions.
You must not use the Service to engage in spam, phishing, or fraudulent activities. This includes using the Service to generate content for spam emails, fraudulent websites, or other deceptive communications. Any attempt to use the Service to defraud, deceive, or harm others will result in immediate account termination and may be reported to relevant authorities.
Technical abuse of the Service is also strictly prohibited. This includes attempting to gain unauthorized access to the Service or related systems, interfering with or disrupting the Service or servers, using automated systems such as bots or scripts to access the Service without authorization, or attempting to reverse engineer, decompile, or disassemble any part of the Service. Such activities may constitute violations of computer fraud and abuse laws and will result in immediate account termination.
Commercial misuse of the Service is prohibited. You must not resell, redistribute, or sublicense access to the Service, nor may you use the Service to compete with us or to build a competing service. The Service is provided for your personal or business use in accordance with these Terms, and any commercial exploitation beyond the scope of your subscription is prohibited.
Impersonation and misrepresentation are strictly prohibited. You must not impersonate any person or entity, or misrepresent your affiliation with any person or entity. This includes creating accounts under false pretenses, using false information during registration, or using the Service to create content that falsely represents you as someone else or as affiliated with an organization with which you have no connection.
5.3 Content Responsibility
You are solely and exclusively responsible for all content you generate, create, or distribute using the Service. This responsibility extends to all aspects of the content, including its accuracy, legality, appropriateness, and compliance with applicable laws and regulations. We do not review, monitor, or control user-generated content, and we are not responsible for such content in any way.
It is crucial to understand that AI-generated content may contain errors, inaccuracies, or biases. AI models, while sophisticated, are not infallible and may produce outputs that are factually incorrect, incomplete, or reflect biases present in their training data. AI models may also generate content that appears plausible but is actually false or misleading. Therefore, you must exercise appropriate caution and judgment when using AI-generated content.
Before using any AI-generated content, you should carefully verify and review it to ensure it meets your needs and standards. This includes fact-checking information, verifying accuracy, reviewing for appropriateness, and ensuring compliance with applicable laws and regulations. You should not rely solely on AI-generated content for critical decisions, legal advice, medical information, financial advice, or other matters where accuracy is paramount.
You are responsible for ensuring that all content you generate, create, or distribute using the Service complies with applicable laws and regulations. This includes laws regarding copyright, trademark, privacy, defamation, consumer protection, and content regulation. If you use AI-generated content in a way that violates laws or infringes on the rights of others, you will be solely liable for any resulting consequences, and we will not be responsible for any damages, legal claims, or other consequences that may arise.
We disclaim all liability for any consequences resulting from your use of AI-generated content. This includes but is not limited to liability for damages, legal claims, regulatory actions, or other consequences that may arise from your use, distribution, or reliance on AI-generated content. By using the Service, you acknowledge and agree that you assume all risks associated with the use of AI-generated content.
6. Intellectual Property
6.1 Service Ownership
The Service, including all content, features, functionality, software, and materials, is owned by FollowerX GmbH or its licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 User-Generated Content
You retain ownership of content you create using the Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.
6.3 AI Model Ownership
AI models accessible through our Service are provided by third parties (primarily Replicate.com and model creators). Ownership and licensing of AI models are governed by the terms and licenses of the respective model creators. We do not claim ownership of third-party AI models.
6.4 AI-Generated Content Ownership
Ownership of content generated using AI models is a complex legal area that varies by jurisdiction. Generally:
- You may have rights to content you generate, subject to the terms of the AI model providers
- Some jurisdictions may not recognize copyright in AI-generated content
- You are responsible for understanding and complying with applicable laws regarding AI-generated content
- We make no warranties regarding your ownership rights in AI-generated content
7. Third-Party Services and Content
The Service integrates with and relies on third-party services, including:
- Replicate.com: Provides access to AI models
- Stripe: Processes payments
- Google Analytics & Google Ads: Provides analytics and advertising services
- OpenAI: Provides translation and content generation services
- DeepL: Provides translation services
- NextAuth: Provides authentication services
Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
8. Disclaimers and Limitations
8.1 Service Availability
We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
8.2 AI Model Accuracy
AI models may produce inaccurate, incomplete, or inappropriate content. We do not guarantee the accuracy, reliability, or suitability of any AI model outputs. You should:
- Review and verify all AI-generated content before use
- Not rely solely on AI-generated content for critical decisions
- Understand that AI models may have biases or limitations
- Use AI-generated content at your own risk
8.3 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
8.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOLLOWERX GMBH, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Subscription Cancellation and Termination
9.1 Cancellation by You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.
9.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, if you:
- Violate these Terms or our Privacy Policy
- Engage in fraudulent, illegal, or harmful activities
- Fail to pay subscription fees when due
- Use the Service in a manner that could harm us or other users
9.3 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease
- All unused credits will be forfeited
- We may delete your account and associated data in accordance with our Privacy Policy
- You remain responsible for all fees incurred before termination
10. Modifications to Terms and Service
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date at the top of this page
- Sending an email notification to your registered email address (for material changes)
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.
We also reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
11.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.
11.3 EU Online Dispute Resolution
If you are a consumer resident in the European Union, you may use the European Commission's Online Dispute Resolution platform to resolve disputes. The platform is available at: http://ec.europa.eu/consumers/odr
11.4 Informal Resolution
Before initiating formal dispute resolution, we encourage you to contact us to attempt to resolve any disputes informally.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
12.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
12.5 Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or failures of third-party services.
